Use

This Agreement governs the conditions of use of the Transitica platform. Please read this document carefully before using the service.

Important before reading Transitica is an information platform and does not provide transport services. By using the website, you confirm that you have read this Agreement and accept its terms in full. If you do not agree with these terms, please refrain from using the service.

General Provisions

This Terms of Use Agreement (hereinafter — the "Agreement") constitutes a public offer and governs the relationship between the administration of the website transitica.com (hereinafter — "Transitica", "Platform", "Administration") and any individual accessing the website and its services (hereinafter — "User").

The Agreement enters into force from the moment of first use of the Platform — including browsing pages, submitting a booking form, registering an account, or any other interaction with the services.

This Agreement is the authoritative version for English-speaking users. In the event of any discrepancy between language versions, the meaning intended by the Administration shall prevail as determined by the context of the original text.

Terms and Definitions

For the purposes of this Agreement, the following definitions apply:

Term Meaning
Platform The website transitica.com and all its subdomains, including the mobile version — an information aggregator and online booking system that does not itself provide transport services.
User Any individual aged 18 or over, or acting with the consent of a legal guardian, who visits or uses the functionality of the Platform.
Carrier A legal entity or individual that directly provides passenger transport services (bus operator, airline, rail operator) and bears full responsibility for the performance of those services.
Partner / Agency A travel agency, consolidator, or other counterparty of the Platform on whose behalf tour, transfer, or other related service offerings are listed.
Booking A User's request to reserve a seat or tour transmitted by the Platform to a Carrier or Partner; it does not constitute a public contract of carriage until confirmed by the Carrier.
Intermediary Payment Services An optional Platform service facilitating payment: collecting funds from the User and transferring them to the Carrier or Partner as a prepayment for a booking.
Route A specific transport itinerary with fixed departure and arrival points, date, time, and fare, offered by a Carrier.
Content Any materials published on the Platform: texts, images, prices, schedules, news articles, and informational publications.

Subject Matter

The subject matter of this Agreement is the Administration's provision of access to the Platform's features to the User on the terms described herein.

The Platform's main areas of activity are:

  • Aggregation of route information (bus services; air and rail routes in development) and online seat booking;
  • Aggregation of travel offers (tours, transfers) and online booking with Partners;
  • Optional intermediary services for payments between the User and the Carrier / Partner;
  • Publication of editorial content: transport industry news, informational articles, and travel guides.

At present, the Platform's primary activity is intercity bus passenger transport. Air, rail, and tour booking features are under development and may be limited or unavailable.

Platform Status — Not a Carrier

4.1. Transitica is not a Carrier

Transitica is exclusively an information and service platform. The Platform does not provide passenger transport services, does not deliver transportation, and is not a party to any contract of carriage. All contracts of carriage are concluded directly between the User and the relevant Carrier.

4.2. Role as Intermediary

Transitica acts as a technology intermediary: it receives and processes booking requests, transmits data to the Carrier or Partner, and where necessary facilitates payment. The Platform is not a party to the legal relationship arising between the Carrier and the User during or after the journey.

4.3. Route Information

All information regarding schedules, fares, routes, conditions of carriage, and seat availability is provided by the Carrier or Partner. The Platform does not guarantee the accuracy, completeness, or currency of such data and accepts no liability for discrepancies with actual journey conditions.

Boarding: passengers are required to present a valid identity document (passport, national ID card, or another document accepted by the Carrier). Failure to comply may result in denial of boarding without a refund — at the Carrier's sole discretion.

4.4. Liability for Carriage

The Carrier bears full and exclusive responsibility for the quality, timeliness, and safety of carriage, including delays, cancellations, lost baggage, personal injury, and any other incidents occurring during or directly connected to the journey.

Platform Services

5.1. Search and Browse

Users may freely use the Platform's search tools to find and compare available routes and tours. The display of a route in search results does not constitute an offer and does not guarantee seat availability or price stability.

5.2. Booking

After selecting a route, the User completes the booking form. The form data is transmitted to the Carrier or Partner for confirmation. A booking is considered complete once the User receives confirmation from the Carrier or from the Platform on the Carrier's behalf.

5.3. Intermediary Payment Services

Where a Carrier or Partner requires advance payment, the Platform may provide intermediary services: collecting funds from the User and transferring them to the Carrier or Partner. In such cases, Transitica acts solely as a payment agent and does not retain funds for its own account.

In most cases, no advance payment is required at the time of booking. Payment is made directly to the Carrier upon boarding or in accordance with the Carrier's own rules.

5.4. Editorial Content

The Platform publishes news articles, destination guides, travel tips, and other informational materials prepared by its editorial team. Such materials are for informational purposes only and do not constitute an offer, advertisement of specific routes, or a recommendation.

5.5. Access Restrictions

The Administration reserves the right at any time to restrict, suspend, or terminate a User's access to some or all Platform features in the event of a breach of this Agreement, at the request of competent authorities, or on other lawful grounds.

Registration and User Account

Use of certain Platform features (booking history, newsletter subscription) may require the creation of a personal account. Upon registration, the User must provide accurate, complete, and up-to-date information about themselves.

  • The User is responsible for maintaining the confidentiality of their login credentials and for all activity carried out using their account.
  • Account registration is permitted to individuals aged 18 or over. Persons under 18 may use the service only with the consent of and under the supervision of a legal guardian.
  • Creating multiple accounts by the same person for the purpose of circumventing Platform restrictions is prohibited.
  • If the User becomes aware of any unauthorised access to their account, they must notify the Administration immediately.
  • The Administration reserves the right to block or delete an account in the event of a breach of this Agreement or applicable law.

Booking Procedure

7.1. Process

  1. The User selects a destination, date, and route using the search form on the website.
  2. The User completes the booking form: entering their name, contact details, number of seats, and any other information required by the Carrier.
  3. The Platform transmits the request to the Carrier or Partner.
  4. The User receives booking confirmation via the specified contact channel (phone, email, or messenger).
  5. If advance payment is required, it is made through the designated payment method (see §8).

7.2. Confirmation and Ticket

The booking confirmation serves as the basis for boarding the vehicle. The format of confirmation (SMS, email, screenshot of correspondence) is determined by the Carrier. A valid identity document is required for boarding under all circumstances.

7.3. Data Accuracy

The User bears full responsibility for the accuracy of the data entered in the booking form. Incorrect name, date of birth, route, or travel date may result in denial of boarding. Any changes to a confirmed booking are subject to the Carrier's own terms and require the Carrier's agreement.

7.4. Children's Fares and Concessions

Conditions for the carriage of children, senior citizens, and persons with disabilities (discounts, special seating, accompanying person requirements) are governed by each Carrier's rules. Users must confirm these conditions directly with the Carrier before booking.

7.5. Visas and Border Control

The User is solely responsible for obtaining all documents required to enter the destination country or transit through any country (visa, entry permit, medical documents). The Platform does not provide visa advice and accepts no liability for denial of border crossing.

Payment

8.1. Default Model — Payment on Boarding

In most cases, the fare is paid directly to the Carrier — in cash or by card — upon boarding the vehicle or at another time specified by the Carrier. In this model, the Platform is not involved in the payment process and does not collect any funds.

8.2. Advance Payment via the Platform (Intermediary Services)

Where the Carrier's or Partner's terms require advance payment, the User may use the Platform's intermediary payment services:

  • Payment is processed through the payment gateway integrated on the website, using available methods: bank card (Visa, Mastercard), e-wallets, or other methods at the Platform's discretion.
  • Upon receipt of the payment, the Platform transfers the corresponding amount to the Carrier or Partner under an agency agreement.
  • A payment receipt is sent to the User's specified email address or via messenger.

8.3. Currency and Conversion

Prices on the website are displayed in the currency specified by the Carrier (Ukrainian hryvnia, US dollars, euros, or another currency). When paying by card, currency conversion is applied at the acquiring bank's exchange rate. The Platform accepts no liability for exchange rate differences.

8.4. Payment Security

Payment details (card number, CVV) are processed exclusively by the payment gateway and are not stored on the Platform's servers. All transactions are conducted in accordance with the PCI DSS standard.

8.5. Service Fees

The Platform may charge a service fee for intermediary payment services. Where applicable, the fee is displayed as a separate line item in the payment form prior to transaction confirmation.

Cancellation, Amendment, and Refunds

9.1. Carrier Cancellation Policy

The conditions for cancelling a booking, and the procedure and amount of any refund, are determined exclusively by the Carrier's or Partner's own policies. The Platform does not set these conditions and has no authority to modify them. Users must review the cancellation terms for a specific route or tour before completing a booking.

9.2. Cancellation by the User

To cancel a booking, the User must notify the Platform in a timely manner through any available communication channel. The Platform will promptly transmit the cancellation request to the Carrier. Submitting a cancellation request via the Platform does not automatically guarantee a refund — the decision rests with the Carrier.

9.3. Refunds for Payments Made via the Platform

If payment was made through the Platform's intermediary services and the Carrier has approved a refund, the Platform undertakes to transfer the funds to the User within 10 business days of receiving confirmation from the Carrier, less any non-refundable fees set by the Carrier.

9.4. Carrier-Initiated Cancellation

If a route is cancelled by the Carrier (technical reasons, force majeure, schedule change), the Platform will notify the User using the contact details on file. All claims regarding refunds and alternative travel arrangements must be directed to the Carrier.

Force Majeure: border closures, natural disasters, military operations, pandemics, and other circumstances beyond reasonable control may entitle the Carrier to decline a refund. The Platform bears no liability in such cases.

9.5. Right of Withdrawal (EU — Directive 2011/83/EU)

For Users in European Union member states: transport services are generally excluded from the 14-day right of withdrawal under the Consumer Rights Directive 2011/83/EU. The applicable refund rules depend on the individual Carrier's policy.

10
Liability

10.1. Platform Liability

Transitica is liable solely for the proper functioning of the Platform's technical infrastructure, to the extent provided by applicable law. The Platform makes reasonable efforts to ensure uninterrupted service availability but does not guarantee continuous access.

The Platform accepts no liability for:

  • Non-performance or improper performance of carriage by a Carrier;
  • Delays, cancellations, route changes, or schedule amendments;
  • Damage, loss, or delay of baggage;
  • Personal injury or property damage suffered by the User during carriage;
  • Discrepancies between actual journey conditions and information displayed on the website as provided by the Carrier;
  • Denial of border crossing to the User;
  • Losses arising from inaccurate data entered by the User during booking;
  • Losses caused by force majeure circumstances;
  • Actions of third parties, including payment systems and banks.

10.2. User Liability

The User bears full responsibility for:

  • The accuracy and completeness of data provided during booking;
  • Holding all required travel documents (passport, visa, insurance policy);
  • Complying with the terms and conditions of carriage set by the Carrier;
  • Maintaining the security of their Platform account credentials;
  • Complying with the laws of the country of departure, transit, and destination.

10.3. Limitation of Aggregate Liability

The Platform's total liability to the User on any grounds relating to use of the service shall not exceed the service fee actually paid by the User to the Platform in connection with the relevant transaction. If no service fee was charged, the Platform's liability is limited to the minimum amount permitted by applicable law.

Platform Content

11.1. Editorial Content

News articles, travel guides, and other publications are prepared by the Transitica editorial team and are for informational purposes only. They do not constitute legal, medical, financial, or professional advice. The editorial team strives for accuracy but does not guarantee that content is complete or current at the time of reading.

11.2. Route Information

Schedules, fares, and other route data are provided by Carriers. The Platform displays this information "as is" and accepts no liability for errors or outdated data. Users should verify current information directly with the Carrier.

11.3. Prohibited Activities

Users are prohibited from:

  • Copying, reproducing, or distributing Platform materials without the Administration's written consent;
  • Using automated tools (bots, scrapers) to collect data from the website;
  • Posting false, misleading, or unlawful information on the website;
  • Taking any action intended to disrupt or impair the Platform's operation.

Personal Data and Privacy

The processing of Users' personal data is carried out in accordance with the Platform's Privacy Policy, which forms an integral part of this Agreement and is available at: transitica.com/privacy.

12.1. Purposes of Processing

  • Performing booking functions and transmitting data to the Carrier or Partner;
  • Sending booking confirmations and notifications of changes;
  • Sending newsletters and special offers (only with the User's consent);
  • Providing technical support and improving service quality;
  • Complying with legal requirements.

12.2. User Rights (GDPR and Equivalents)

Users in the European Union and other jurisdictions providing equivalent rights are entitled to:

  • Request access to their personal data held by the Platform;
  • Request correction of inaccurate data;
  • Request deletion of data ("right to be forgotten") where no lawful basis for retention exists;
  • Object to the processing of data for marketing purposes;
  • Receive a copy of their data in a machine-readable format (right to data portability).

12.3. Cookies

The Platform uses cookies to support website functionality, analytics, and personalisation. A detailed description of the cookies used is provided in the Privacy Policy. Users may manage cookie settings through their browser.

12.4. Applicable Data Protection Law

When processing data, the Platform complies with: EU Regulation 2016/679 (GDPR) — for users in the EU/EEA; the Law of Ukraine "On Personal Data Protection" — for users in Ukraine; and other applicable national data protection laws.

Intellectual Property

All elements of the Platform — the name "Transitica", logo, design, source code, texts, graphics, databases, and other materials — are objects of intellectual property belonging to the Administration or its licensors and are protected by copyright law.

The User is granted a limited, non-exclusive, non-transferable licence to use the Platform solely for personal, non-commercial purposes. Any other use — reproduction, publication, sale, or creation of derivative works — requires the Administration's prior written consent.

Editorial publications (news articles, travel guides) are protected by copyright. Quotation is permitted up to 300 characters, provided a link to the source — transitica.com — is included.

14
Governing Law and Dispute Resolution

14.1. Governing Law

This Agreement is governed by and construed in accordance with applicable law, determined by reference to the User's place of habitual residence:

  • For users in the EU / EEA: the law of the EU member state in which the User habitually resides applies, together with EU consumer protection legislation (including Directive 2011/83/EU and the GDPR). The parties acknowledge the jurisdiction of the courts of the User's country of residence.
  • For users in Ukraine: Ukrainian law applies, including the Civil Code of Ukraine, the Law "On Consumer Rights Protection", and the Law "On Personal Data Protection". Disputes shall be resolved before Ukrainian courts.
  • For users in other jurisdictions: to the extent not addressed by this Agreement, the rules of private international law and the laws of the User's country of residence apply.

14.2. Pre-Litigation Dispute Resolution

Before initiating court proceedings, the User must submit a written claim to the Administration setting out the substance of their complaint. The Administration undertakes to review the claim and provide a reasoned response within 30 calendar days of receipt.

14.3. Alternative Dispute Resolution (EU)

Users in EU member states may use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.

15
Amendments to the Agreement

The Administration reserves the right to amend this Agreement at any time. Users will be notified of material changes by publication of the updated version on the website with a new effective date, and/or by email notification (where an account exists).

Continued use of the Platform after the changes take effect constitutes the User's unconditional acceptance of the revised Agreement. If the User does not agree to the changes, they must cease using the Platform.

The current version of the Agreement is always available at: transitica.com/terms. Previous versions are available upon request.
